Proposed Regulation Changes

On Nov. 14, 2016 the Division for Air Quality filed an amendment to the following administrative regulations:

  • 401 KAR 60:005. 40 C.F.R. Part 60 standards of performance for new stationary sources
  • 401 KAR 63:002. 40 C.F.R. Part 63 national emission standards for hazardous air pollutants
  • 401 KAR 63:060. List of hazardous air polluntants, petitions process, lesser quantity designations, and source category list.

On July 12, 2016, the Division for Air Quality filed the Statement of Consideration and an Amended After Comments version of 401 KAR 51:010 Attainment Status Designation.

 In response to comments received during the public comment period, which ended Nov. 2, 2015, the Division filed the attached Statement of Consideration and amended Regulatory Impact Analysis and Tiering Statement.  Official versions may be found at the Kentucky Legislative Research Commission’s (LRC) Website once it is updated at www.lrc.ky.gov/kar/TITLE401.HTM.


The Kentucky Division for Air Quality filed amendments to the following administrative regulations:

These amendments were made in response to comments received during the public comment period, which ended on Aug. 31, 2010.  Attached are the regulations and Statement of Consideration as filed with the Legislative Research Commission (LRC).

Also, please note that as of Oct. 7, 2010, amendments to 401 KAR 59:015, New indirect heat exchangers, became effective.  Official versions may be found at the LRC Web site once it is updated www.lrc.ky.gov/kar/TITLE401.HTM.

The Kentucky Division for Air Quality filed amendments to the following administrative regulations:

 These amendments were made in response to comments received during the public comment period, which ended on July 31, 2012.  Comments were also received on 401 KAR 51:052, Review of new sources in or impacting upon nonattainment areas, but amendments were not warranted.  Attached are the two amended regulations and the Statements of Consideration pertaining to this regulation package, as filed with the LRC on Sept. 12, 2012.
